These Terms summarize the legal relationship between you and Artificane in plain language where possible. They are not legal advice. If you need legal advice about your use of the Service, please consult a qualified lawyer in your jurisdiction.
These Terms of Service ("Terms") form a binding agreement between you and Artificane, a service operated by Mustafa Kayra Tozan, a sole proprietor (şahıs şirketi) based in İstanbul, Türkiye ("Artificane", "we", "us"). Full legal-entity and contact details are on our Imprint (/imprint). By creating an account, accessing, or using the Artificane website, applications, APIs, or any related service (collectively, the "Service"), you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and references to "you" include that organization.
Artificane is an adults-only Service. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or use the Service. We do not knowingly permit anyone under 18 to register, and we do not direct the Service to minors. If we learn that an account belongs to someone under 18, we may suspend or close it.
You must not be barred from using the Service under the laws of your jurisdiction or any applicable export-control or sanctions regime.
You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at security@artificane.com if you suspect unauthorized access.
You must provide accurate information when creating an account or submitting content. Impersonation, false attribution, and misrepresentation are grounds for suspension.
You retain ownership of films, prompts, comments, and other content you submit ("User Content"). You grant Artificane a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes such as encoding and thumbnail extraction), publicly display, and distribute your User Content for the purpose of operating, promoting, and improving the Service.
You represent and warrant that (a) you own or have all rights necessary to grant this license, (b) your User Content does not infringe any third party's intellectual property, privacy, publicity, or other rights, and (c) your User Content complies with all applicable laws.
Artificane may, at its discretion, refuse, remove, or restrict access to any User Content for any reason, including suspected violation of these Terms.
Artificane is built around AI-generated film. You agree to truthfully disclose the AI tools, prompts, and workflows used to create your submissions. Misrepresenting human-only work as AI-generated, or vice versa, is a material breach of these Terms.
Artificane does not own or control the third-party AI tools (e.g., Sora, Runway, Pika, Midjourney, Suno) used to produce User Content. Their outputs and licensing terms are governed by their respective providers; you are responsible for complying with those terms.
Artificane makes no representation that AI-generated outputs you create or view are protectable by copyright in your jurisdiction.
You agree not to: (a) upload content that is illegal, defamatory, harassing, threatening, hateful, sexually explicit involving minors, or that incites violence; (b) infringe intellectual property, privacy, or publicity rights of others; (c) upload malware, automated scrapers, or attempt to bypass authentication, rate limits, or security controls; (d) misuse referral, marketplace, or sponsorship features (fraud, money laundering, fake reviews); (e) use the Service to train competing models without our written permission; (f) reverse engineer non-public APIs.
We may suspend or terminate your access for any violation of this section.
In addition to the general restrictions in Section 6, the following content is strictly prohibited on Artificane:
Violations may result in immediate content removal, account suspension, and referral to relevant rights holders. You are solely responsible for any legal claims arising from your submissions.
Artificane Pro subscriptions, AI generation credits, and other digital products we sell directly (such as courses) are sold by Artificane through Paddle.com, which acts as our Merchant of Record (the authorized reseller) and handles billing, payment, and tax for those products. By making a purchase you authorize the charge and accept Paddle's buyer terms. Prices and platform fees are shown at checkout and may change with notice.
Auto-renewal: paid subscriptions renew automatically at the end of each billing period at the then-current price, using your saved payment method, until you cancel. We disclose the price and billing interval before purchase, and you can cancel at any time in /settings before the next renewal; cancellation stops future charges and takes effect at the end of the current period.
Marketplace sellers are independent of Artificane. For items listed by other users Artificane is not the seller and is not party to the transaction; we provide the marketplace infrastructure only, and any payouts to sellers and creators are made manually via Wise, bank transfer, or Paddle, using the destination you provide when you request a withdrawal. Sellers are solely responsible for their tax obligations, refunds, and the legality of items they list.
Refunds, cancellations, and the consumer right of withdrawal are governed by our Refund Policy (/refund). Subscription fees are not pro-rated on cancellation unless required by law.
If you believe content on the Service infringes your copyright, send a notice meeting the requirements of the U.S. Digital Millennium Copyright Act (DMCA) to our designated agent at dmca@artificane.com. Full instructions and the required elements of a valid notice and counter-notice are set out on our DMCA page (/dmca).
We may remove allegedly infringing material and terminate repeat infringers in accordance with the repeat-infringer policy described on the DMCA page. False claims may result in liability under 17 U.S.C. § 512(f).
The Service integrates with third-party services (Supabase, Paddle, Stripe, Resend, Upstash, Vercel, AI tool providers, social platforms). Their use of your data is governed by their own terms and privacy policies. Artificane is not responsible for the acts or omissions of third parties.
You may close your account at any time through /settings. We may suspend or terminate your access at any time, with or without notice, for breach of these Terms, suspected fraud, legal compulsion, or to protect the Service or its users. Where we terminate or restrict your account, we will tell you the reason unless doing so is prohibited by law or would compromise an investigation (see Section 18).
Sections that by their nature should survive (4, 6, 12, 13, 14, 15, 17, 18, 20) survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.
Artificane does not warrant that User Content, AI-generated outputs, prompts purchased through the marketplace, or third-party tool integrations will meet your expectations, be error-free, or be available at any particular time.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTIFICANE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ARTIFICANE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO ARTIFICANE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$100.
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law.
You agree to defend, indemnify, and hold harmless Artificane and its affiliates from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any third-party right, including intellectual property, privacy, or publicity rights.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. This choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you habitually reside.
Informal resolution first. Before starting any formal proceeding, you agree to contact legal@artificane.com and attempt to resolve the dispute informally for at least 30 days.
Binding individual arbitration (users outside the EEA, UK, and Switzerland). Except where prohibited by law, any dispute not resolved informally will be settled by final and binding individual arbitration rather than in court — except that either party may (a) bring an individual claim in small-claims court, or (b) seek injunctive or equitable relief for intellectual-property infringement or unauthorized access to the Service. Arbitration is conducted in English, on an individual basis, under the consumer rules of a recognized arbitration body.
Class-action waiver. To the maximum extent permitted by law, you and Artificane will bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims. If this waiver is held unenforceable for a particular claim, that claim (and only that claim) is severed and heard in the courts identified below.
30-day opt-out. You may opt out of the arbitration and class-action waiver in the two paragraphs above by emailing legal@artificane.com within 30 days of first accepting these Terms, stating your name and account email. Opting out does not affect any other part of these Terms.
EEA / UK / Switzerland consumers, and courts. If you are a consumer in the EEA, the UK, or Switzerland, the arbitration and class-action provisions above do not apply to you; you may bring proceedings in the courts of your country of residence, and your home-country consumer protections continue to apply (see Section 16). For all disputes not subject to arbitration, the courts of Istanbul, Türkiye have jurisdiction and you and Artificane consent to that forum, without limiting any mandatory right of consumers to sue in their local courts.
If you are a consumer (a natural person acting outside your trade, business, or profession), you may have statutory rights that these Terms do not override, including rights regarding faulty digital content or services.
Right of withdrawal (EEA / UK): for paid digital content or services bought directly from Artificane (e.g., Artificane Pro, premieres), you generally have 14 days to withdraw from the purchase. By buying and asking for immediate access, you expressly request that we begin performance during the withdrawal period and acknowledge that you lose the right of withdrawal once the service has been fully performed, or — for digital content — once download or streaming has begun with your prior consent.
Marketplace purchases: items listed by other users are sold by those users, not by Artificane. Your statutory consumer rights against a seller depend on whether that seller is acting as a trader; where we know a seller's status, we indicate it on the listing. Artificane provides the marketplace infrastructure and is not a party to those contracts.
To exercise a withdrawal or refund right, contact billing@artificane.com. These rights are in addition to, and do not limit, the practices described in our Refund Policy (/refund).
We enforce these Terms and our Content Guidelines (/guidelines) using a graduated system. Depending on the severity and frequency of a violation, enforcement may include a warning, removal or age-restriction of content, temporary feature or account restrictions, suspension, or permanent termination.
Copyright infringement is handled separately under Section 9 and the repeat-infringer policy on our DMCA page. Other violations (for example, prohibited content under Section 7, fraud, or harassment) are tracked under this Section.
Where lawful, we will notify you of an enforcement action against your account or content and give the reason for it (see Section 18). You may appeal most decisions through the dispute process at /dispute; appeals are reviewed by someone not involved in the original decision.
Severe violations — including content that sexually exploits minors, credible threats of violence, or coordinated fraud — may result in immediate termination without prior warning and, where required by law, referral to the relevant authorities.
Anyone — whether or not they have an account — can report content they believe is illegal or violates these Terms using the dispute form at /dispute or the in-product report control on each film. Reports should identify the content and explain why it is unlawful or violating so we can assess it.
When we remove, disable, restrict, or demote content you posted, or restrict your account, because of a report or our own review, we will provide you with a statement of reasons explaining the decision and the available redress options, unless the law prohibits this or it would obstruct an investigation.
Internal complaint handling: you may contest a moderation or enforcement decision free of charge for at least six months after the decision by submitting an appeal at /dispute. We review appeals diligently and reverse decisions that were made in error.
Single point of contact: for notices, regulator correspondence, and questions about content moderation, contact legal@artificane.com. This Section is intended to support our notice-and-action obligations toward users in the European Union; it does not create rights beyond those required by applicable law.
We may update these Terms from time to time. If a change is material, we will provide at least 14 days' notice via email or in-app banner before it takes effect. Your continued use of the Service after the effective date constitutes acceptance.
These Terms, together with our Privacy Policy, are the entire agreement between you and Artificane regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
