This page describes our notice-and-takedown procedure and is provided for transparency. It is not legal advice. If you have specific legal questions about a copyright matter, consult a qualified attorney in your jurisdiction.
Artificane, a service operated by Mustafa Kayra Tozan (a sole proprietor based in İstanbul, Türkiye), respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512) and analogous notice-and-takedown frameworks in other jurisdictions.
If you believe content on the Service infringes a copyright you own or are authorized to enforce, follow the procedure below. We will respond to complete, good-faith notices.
Send copyright notices and counter-notices to our Designated Agent:
Mustafa Kayra Tozan (Artificane) — Attn: DMCA Designated Agent
Email: dmca@artificane.com
Postal address: Mustafa Kayra Tozan, Kartal, İstanbul 34880, Türkiye.
To qualify for the DMCA safe harbor under 17 U.S.C. § 512, a service provider must register a designated agent with the U.S. Copyright Office and keep the agent's name, address, phone number, and email current in the Copyright Office's DMCA Designated Agent Directory. Our designated agent's contact details are also available on request at dmca@artificane.com.
Under 17 U.S.C. § 512(c)(3), your notice must include all of the following — incomplete notices may be ignored:
(a) A physical or electronic signature of the copyright owner or an authorized representative.
(b) Identification of the copyrighted work claimed to be infringed (or a representative list if multiple works).
(c) Identification of the material claimed to be infringing, with enough detail to locate it on the Service (URL or film slug).
(d) Your contact information: full legal name, postal address, telephone number, and email.
(e) A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
(f) A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.
If your content was removed in response to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice. The counter-notice must include:
(a) Your physical or electronic signature.
(b) Identification of the material removed and the location at which it appeared before removal.
(c) A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
(d) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. District Court for your district (or, if outside the U.S., for the Northern District of California), and that you will accept service of process from the person who submitted the notice.
We will forward valid counter-notices to the original complainant. If the complainant does not file an action seeking a court order within 10–14 business days, we may restore the removed material.
In accordance with the DMCA and other applicable laws, Artificane terminates, in appropriate circumstances, the accounts of users who are repeat infringers. We track DMCA notices internally and apply a strike-based policy. Three substantiated notices within a 12-month period typically result in account termination.
Knowingly submitting a materially false DMCA notice or counter-notice may result in liability for damages, including costs and attorneys' fees. If you are unsure whether you have the right to send a notice, consult a qualified attorney before doing so.
In addition to email, you can submit non-DMCA copyright concerns through our in-app dispute system at /dispute. The in-app form is not a substitute for a formal DMCA notice; if you require DMCA-statute protection, send the notice to dmca@artificane.com with the elements above.
This page addresses copyright. For trademark complaints, right-of-publicity complaints, or other intellectual property concerns, email legal@artificane.com with a clear description, the location of the offending content, and the legal basis for your complaint.
